2. Our Service

WaterCalculations.co.uk provides an online water efficiency calculation service designed to assist with water efficiency assessments for dwellings under applicable UK Building Regulations requirements.

Users may complete a water efficiency calculation free of charge. Where a calculation achieves the selected target, users may choose to purchase professional Water Efficiency Reports and associated calculation documents.

Purchased documents may include a Water Efficiency Report, Part G Calculation Schedule and related supporting documents depending on the type and number of dwellings included in the order.

These documents are intended to support Building Regulations compliance submissions and may be provided to a Building Control body, architect, designer, developer, contractor, homeowner or other relevant party.

3. Building Control and Regulatory Approval

WaterCalculations.co.uk and One Stop Consult Ltd are not acting as a Building Control body when providing the Water Calculations service. Our Water Efficiency Reports do not themselves constitute Building Regulations approval, a completion certificate or any other form of regulatory approval.

Our reports are prepared using the information supplied by the user and are intended to assist with demonstrating water efficiency performance for the relevant dwelling or development.

Acceptance of any report remains at the discretion of the relevant Building Control body, local authority, registered building control approver or other relevant authority.

Purchase of a report does not guarantee Building Regulations approval or acceptance by any third party.

4. Accuracy of Information You Provide

The accuracy of every calculation and report depends on the information entered by the user.

You are responsible for ensuring that all information supplied is complete, accurate and appropriate for the property or development being assessed, including where applicable:

• property and project details;
• plot numbers and addresses;
• dwelling types and bedroom information;
• sanitary appliance quantities;
• toilet flush volumes;
• tap and shower flow rates;
• bath capacities;
• appliance consumption figures;
• rainwater or greywater information;
• fixture and fitting specifications; and
• company details, logos or branding uploaded by you.

We are not responsible for an incorrect result, report or regulatory outcome caused by inaccurate, incomplete, outdated or misleading information supplied by the user.

You should check the information entered and the calculation result carefully before purchasing your reports.

5. Calculation Methodology

Water efficiency calculations are produced using the methodology implemented within the Water Calculations calculation system and are intended to follow the applicable methodology for calculating water consumption for dwellings under Approved Document G.

The user is responsible for selecting the appropriate water efficiency target for their project and for confirming any project-specific Building Regulations, planning, Building Control or other regulatory requirements.

Where manufacturer-specific performance information is entered, the user is responsible for ensuring that those figures accurately represent the products intended to be installed.

6. Free Calculations

The online calculator may be used without purchasing a report.

A free calculation result is provided for information and assessment purposes. There is no obligation to purchase a Water Efficiency Report after completing a calculation.

The availability of a free calculation does not create an obligation for us to provide professional advice, regulatory approval or any additional service unless separately agreed.

7. Prices and VAT

Current prices are displayed on WaterCalculations.co.uk before an order is placed.

Unless expressly stated otherwise, prices shown excluding VAT are subject to VAT at the applicable rate. The total amount payable, including VAT, will be displayed before payment is completed.

Pricing may vary according to the number of plots or dwellings included in an order.

We may change our prices at any time. Any price change will not affect an order for which payment has already been successfully completed.

8. Payment

Payment must be made through one of the payment methods made available during checkout.

An order is not treated as paid until payment has been successfully authorised and confirmed.

We reserve the right not to generate, release or continue providing access to reports where payment has failed, been cancelled, reversed, refunded, disputed or otherwise not successfully completed.

9. Report Generation and Digital Delivery

Purchased Water Efficiency Reports and associated calculation documents are generated electronically using the project and calculation information supplied by the user.

Following successful payment, report generation will normally begin immediately.

Once generated, reports may be made available through your Water Calculations account, order confirmation page, secure download facility or another electronic method provided by us.

Reports are supplied digitally. No physical copy will be posted unless expressly agreed separately.

You are responsible for downloading and retaining copies of documents required for your own records and project.

Occasionally report generation or delivery may be delayed by technical issues, payment processing delays, maintenance or circumstances outside our reasonable control. Where this occurs, we will take reasonable steps to restore access or complete generation.

10. Multiple Plots and Dwelling Types

Where an order contains multiple plots or dwelling types, reports will be generated using the information entered for each relevant plot or dwelling specification.

You are responsible for checking that plot numbers, addresses, dwelling types and specifications have been entered and assigned correctly before completing your purchase.

Where several plots use the same dwelling specification, calculation documents may be generated or grouped in a manner appropriate to that development.

11. Accounts and Report Access

Certain features, including access to purchased reports and order information, may require a Water Calculations account.

You are responsible for keeping your login details and account credentials secure and for activity carried out through your account.

You must notify us as soon as reasonably possible if you believe your account has been accessed without permission.

We may restrict or suspend access where we reasonably believe an account is being misused, compromised, used fraudulently or used in breach of these Terms & Conditions.

12. Cancellations and Refunds

Our Water Efficiency Reports and associated calculation documents are generated specifically using the project information supplied by the customer. Report generation normally begins immediately following successful payment.

Where you are purchasing as a consumer and request immediate supply of digital content or immediate performance of the service, you may be required during checkout to expressly consent to supply or performance beginning immediately and to acknowledge the effect this may have on your statutory right to cancel.

Once your Water Efficiency Reports and associated calculation documents have been generated, the order is considered fulfilled and cannot normally be cancelled or refunded simply because you change your mind.

This is because the documents are generated specifically for the project information you provide and, once generated or issued, we cannot withdraw the documents or reliably determine whether they have already been downloaded, saved, copied, shared with a client or professional, or submitted to Building Control or another third party.

Accordingly, we do not normally provide refunds after report generation because you no longer require the documents, have decided to use another provider, entered incorrect information, selected an incorrect specification, or subsequently changed the project, fixtures, fittings or design.

If you believe there is an error caused by our calculation system or report generation process, please contact us so that we can investigate the issue and, where appropriate, correct or regenerate the affected documents.

Nothing in these Terms & Conditions excludes or restricts any statutory rights that cannot lawfully be excluded. Where applicable law entitles you to a remedy because the service or digital content is faulty, materially not as described or has not been supplied as agreed, your statutory rights remain unaffected.

13. Changes or Errors After Purchase

Reports are generated from the information supplied and confirmed at the time of purchase.

If project details, plot information, fixtures, flow rates, dwelling specifications, addresses or other relevant information change after a report has been generated, a revised calculation or new report may be required.

We are not obliged to amend or regenerate a completed report free of charge where the amendment is required because information was entered incorrectly by the user or because the project or specification changed after purchase.

Where an error has resulted from our system rather than information supplied by the user, please contact us and we will investigate and take appropriate steps to resolve the issue.

14. Uploaded Logos and Company Information

Where you upload a logo, company name, address or other branding for inclusion on reports, you confirm that you have the right and authority to use that material and to provide it to us for this purpose.

You must not upload unlawful, misleading, infringing, offensive or malicious material.

We may refuse to include or may remove uploaded material where we reasonably believe its use would be unlawful, infringe third-party rights or create a security risk.

15. Intellectual Property and Use of Reports

The WaterCalculations.co.uk website, calculator, software, calculation system, report templates, design, branding and original website content are owned by or licensed to One Stop Consult Ltd and are protected by applicable intellectual property laws.

Purchasing a report gives you permission to use, store, reproduce and provide that completed report to relevant parties in connection with the property, dwelling or development for which it was purchased.

This includes providing the report to parties such as Building Control, local authorities, registered building control approvers, architects, designers, developers, contractors, clients and property owners where relevant to the project.

You may not copy, reproduce, reverse engineer, resell, replicate or commercially exploit the Water Calculations software, calculation system or blank report templates except where permitted by law or with our prior written permission.

16. Acceptable Use

You must not use WaterCalculations.co.uk to:

• attempt to gain unauthorised access to the website, accounts, reports, servers or systems;
• interfere with the operation, performance or security of the website;
• introduce viruses, malicious code or automated attacks;
• circumvent payment, authentication or report-access controls;
• use the service for unlawful, misleading or fraudulent purposes;
• obtain reports using payment information you are not authorised to use; or
• misrepresent a Water Efficiency Report or calculation as having been approved or issued by a regulatory authority where this is not the case.

We may suspend or restrict access where reasonably necessary to protect the service, our customers, our systems or One Stop Consult Ltd.

17. Availability of the Website

We aim to keep WaterCalculations.co.uk available and functioning reliably, but we do not guarantee that the website or every feature will always be available without interruption or error.

The website may occasionally be unavailable because of maintenance, updates, hosting issues, internet outages, payment-provider interruptions, security measures or circumstances outside our reasonable control.

We may modify, update or replace parts of the website or calculation service where reasonably necessary to maintain, improve or secure the service or to reflect changes in applicable requirements.

18. Our Liability

Nothing in these Terms & Conditions excludes or limits liability where it would be unlawful to do so, including any liability that cannot legally be excluded or restricted.

Subject to applicable law, we are not responsible for loss or damage resulting from inaccurate, incomplete or outdated information supplied by the user, changes made to a project after a report has been produced, incorrect use of a report, or a decision by a third party or regulatory body not to accept a report.

Where you use the service for business purposes, to the extent permitted by law we will not be responsible for indirect or consequential losses, loss of profit, loss of revenue, loss of business, loss of opportunity or business interruption.

Nothing in this section affects statutory rights available to consumers or seeks to exclude liability which cannot legally be excluded.

19. Third-Party Services

WaterCalculations.co.uk may rely on third-party services including payment processors, website hosting providers, email services and other technology providers in order to operate the service.

We are not responsible for temporary disruption caused solely by a third-party service outside our reasonable control, although we will take reasonable steps to restore the affected Water Calculations service where possible.

20. Privacy and Personal Information

Personal information collected through WaterCalculations.co.uk is handled in accordance with our Privacy Policy and applicable data protection law.

This may include information required to operate customer accounts, process orders and payments, generate reports, provide customer support and maintain appropriate transaction and business records.

21. Changes to These Terms

We may update these Terms & Conditions from time to time to reflect changes to our service, applicable law, regulatory requirements, technology or business practices.

The version published on WaterCalculations.co.uk at the time an order is placed will normally apply to that order unless applicable law requires otherwise.

The date at the top of this page indicates when these Terms & Conditions were last updated.

22. Governing Law and Jurisdiction

These Terms & Conditions are governed by the laws of England and Wales.

If you are a consumer, you may also benefit from mandatory legal protections and rights available to you in the part of the United Kingdom in which you live.

If you are using the service for business purposes, the courts of England and Wales will have jurisdiction in relation to disputes arising from these Terms & Conditions or use of the service, subject to any mandatory legal requirements that apply.
